Terms of Use
These terms are an agreement between you and Two Fires Studio LLC, a company in the State of Georgia, USA ("we", "us"), about your use of the game Brightmere, its website and its servers ("the game"). By creating an account or playing, you agree to them, to the Payment Terms and to the Privacy Policy. If you do not agree, do not play.
1. Who may play
- You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms for you, and must make any purchase.
- An account is for one person. Do not share it, sell it, give it away or let someone else play on it.
- You are responsible for keeping your password secret and for everything done on your account. Tell us at once if you think someone else has used it.
- Choose an account name and character names that are not offensive, do not impersonate anyone, and do not infringe anyone's rights. We may change or refuse a name.
2. What you get, and what stays ours
- We give you a personal, limited licence to play the game for your own enjoyment. It is not for commercial use, cannot be passed to anyone else, and ends when your account ends.
- The game, its code, art, music, writing and characters belong to us or to those who licensed them to us. Nothing in these terms gives you ownership of any of it.
- Characters, levels, items, marks, cosmetics, membership time and everything else in the game are part of the game. You are licensed to use them while your account is in good standing; you do not own them, and they have no value in money.
- If you send us ideas or feedback, we may use them freely without owing you anything.
3. How to behave
You agree that you will not:
- cheat, or use any bot, script, macro, modified client or other tool to play for you or to gain an advantage;
- exploit a bug or a mistake in the game. If you find one, report it to us and do not use it or tell others how;
- edit, forge or tamper with your saved game, the game's code, or what your game sends to the server;
- attack, probe, overload or try to get into our servers, other players' accounts or other players' devices;
- copy, decompile or reverse engineer the game, or run your own server for it, except where the law says this cannot be forbidden;
- buy, sell or trade accounts, characters, items, marks, cosmetics, membership time or gift codes for real money or anything else of value outside the game;
- harass, threaten, defraud or abuse other players, or use hateful, sexual or otherwise offensive language or names;
- pretend to be us, our staff, or another player;
- break any law while using the game.
4. What we may do about a breach
- If we reasonably believe you have broken these terms, we may warn you, remove what was gained unfairly, set a character or account back, suspend your account, or close it for good. Which of these we choose is up to us and depends on how serious it is.
- For cheating, abusing the game's code, attacking the service, real-money trading or serious abuse of other players, we may close an account without warning.
- If your account is suspended or closed for a breach, your membership and anything else you paid for end with it, and no refund is given, except where the law requires one.
- If you think we got it wrong, write to [SUPPORT EMAIL] within 30 days and we will look again.
5. The game changes, and may stop
- We may change, add to or remove any part of the game at any time, including rules, items, prices in the game and what a membership includes.
- The game may be unavailable from time to time for maintenance, updates or reasons outside our control. We do not promise that it will always be available or free of errors.
- Progress may occasionally be lost or set back by a fault. We will try to put things right but cannot promise to.
- If we decide to shut the game down for good, we will give at least [30] days' notice on the title screen and stop taking payments. Our Payment Terms say what happens to time already paid for.
6. Ending your account
You may stop playing at any time, and may ask us to delete your account by writing to [SUPPORT EMAIL]. Deleting an account removes its characters for good and does not bring a refund. Cancelling a membership is covered in the Payment Terms.
7. No warranties
The game is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the game will be uninterrupted, secure, free of errors, or fit for a particular purpose.
8. Limit of our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost data or lost profits, arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose, or 50 US dollars if that is greater. Some places do not allow some of these limits, so parts of this section may not apply to you.
9. You stand behind your own conduct
If someone brings a claim against us because you broke these terms or the law, you agree to cover our reasonable costs in dealing with it.
10. Law and disputes
- These terms are governed by the laws of the State of Georgia, USA, without regard to its rules on conflicts of law.
- Please write to us first: most problems can be settled by a message to [SUPPORT EMAIL].
- Any court case must be brought in the state or federal courts located in [COUNTY] County, Georgia, and you and we agree to those courts. [TO DECIDE WITH A LAWYER: arbitration and a class-action waiver instead of courts.]
- If you live outside the United States, you may have rights under your own country's consumer law that these terms cannot take away.
11. Changes to these terms
We may change these terms. If a change matters, we will say so on the title screen at least [14] days before it takes effect. If you keep playing after that, you accept the change; if you do not accept it, stop playing and cancel any membership.
12. The rest
- If a court finds part of these terms cannot be enforced, the rest still stands.
- If we do not act on a breach at once, we have not given up the right to act later.
- You may not pass this agreement to anyone else. We may pass it to a company that takes over the game.
- These terms, the Payment Terms and the Privacy Policy are the whole agreement between us about the game.
